Laws And How They Came To Be.
Living in an environment without rules is very dangerous for human existence. Man has always wanted to own everything that they set their eyes on and this is dangerous for the environment. This state of existence would leave no option for some people to exist as they will be deemed weak. In order for everyone to coexist and survive in our society, there needs to be rules that will dictate how people will live.
Many scholars believe that before the enactment of laws, man was in a state of living with o laws. Man was always greedy and wanted to acquire all that he could get his hands on making others suffer. With their knowledge, some figures in society decided to end the injustice. These people came up with laws they thought were good for the people. To live in harmony, people had to be protected from one another’s hostility. Many people were for this idea and that is how these scholars believe laws came into existence.
Laws are positive legal rules that bind people to behave in a particular way. For a law to be followed, it need to be attached to a certain figure that will implement it. Laws advocate for coexistence of individuals. People also follow laws to direct them on what to do. Law basically keep people from doing what is wrong. Breaking the law means that sanctions are introduced to the individual who breaks it.
When people hear of laws, what comes to their mind first is a country. No one sector in society can be free from having governing rules and regulations.
There are different types of laws that govern people and every sector in society has laws.;
The people and the government need to have something that brings them together and this is included in the public laws.
Private laws are the kind of laws that dictate how individuals should relate to one another.
Negative sanctions are administered and dictated by a set of laws known as criminal laws.
Substantive law is the branch of law that defines what is wrong and how to handle a situation and what can be done to avoid the wrong.
We also have international law which is basically a law that defines how countries in the world over should exist in harmony and what could be done to a state that goes against this. This has led to the establishment of an international body like the International Criminal Court that punishes offenders the world over.
Not everyone in the public can understand laws and this calls for trained people like lawyers and judges that are tasked with helping people understand what the law requires.
